Part of presenting your case against an accusation is a real understanding of what wrongdoing that accusation actually implies.
In their rush to indict Trump and his codefendants, the racketeering case against him made allegations so vague that they could not possibly present a legal defence against them.
For that reason, six of the charges (as originally written) that Trump and others are facing in Georgia have been struck down. There is provision for them to be rewritten and resubmitted, but the language as originally written was so vague it was rejected by the court.
In a new ruling on Wednesday, McAfee, who is presiding over the racketeering case, quashed six counts in the indictment, including three counts against Trump for his alleged efforts to solicit former Georgia House Speaker David Ralston and Georgia Secretary of State Brad Raffensperger into violating their oaths of office.
McAfee ruled that the allegations made against the defendants were not detailed enough, finding that “the lack of detail concerning an essential legal element is, in the undersigned’s opinion, fatal.” Willis’ office can refile the counts or appeal his ruling. —Newsweek
What still remains to be seen is whether Fani Willis and Nathan Wade will be disqualified from overseeing this case. That ruling is expected to come down before week’s end.
